From what I understand, the distribution side startup (e.g. Cafe Press) is essentially zero cost. What tasvideos would need is an assortment of design capital.

I would buy a mouse pad displaying some lua program for LoZ II (where the enemies have life points or what have you). I think that would look sweet as hell

The big problem with TASVideos schwag is that it couldn't use any copyrighted content, which includes any game content. So, what're you going to put on there? Text? "I can beat King's Bounty in ten seconds!"?

I could probably get TASVideos T-shirts pressed through Mikebon and distributed worldwide through Suomikauppa -- Suomikauppa is a daughter company of where I work at, and they use Mikebon's services a lot. This option has been open for several years already. The problem is that there's no T-shirt designer with us, and that I have no idea about the expenses this would incur and/or how to get the ball rolling...

Last time this topic was brought up, similar copyright issues were brought up. To respond, I brought up Brian Klevinger's merchandise for 8-bit theater. No one else brought up any counters to it, but I wouldn't be surprised if there were some legal differences. Fun fact: The phrase "brought up" got brought up 6 times in this post, including those last two.

Ferret Warlord beat me to it, but, are you guys sure fair use does not apply? In the U.S., fair use includes four tenants, one of which weighs the fraction of content borrowed. In this case, one frame would be displayed out of tens or hundreds of thousands. The U.S. Supreme Court makes clear that commercial gain does not automatically invalidate a fair use claim. This is U.S. only. I have no idea how it works in the rest of the world. However, the videos the site publishes are likely on shakier ground than the T-shirts, even with profit involved in the latter.

Basically, whenever any Mickey Mouse property is about to enter the public domain, Disney leads a lobbying charge to get Congress to move the goalposts back; the funny thing is that "Steamboat Willie" started life as a fair-use parody of Steamboat Bill Jr. Also, I hope the good word of Lawrence Lessig sinks into Congress and the Administration so they might actually make copyrights *limited* again.
